- Introduction
These terms and conditions (“Agreement”) govern the booking and participation in motorbike tours (“Tour”) offered by Wild Tracks Moto Limitada (“Company,” “we,” “us,” or “our”) in Chile. By booking a Tour with us, you agree to be bound by these terms. If you do not agree with any part of this Agreement, you should not proceed with your booking.
- Booking and Payment
- 2.1 Booking: To book a Tour, you must complete the booking form on our website or directly with our staff. A valid credit card or other payment methods accepted by the Company are required to secure your booking.
- 2.2 Payment: A deposit may be required at the time of booking, with the remaining balance due 7 days before the Tour’s departure. If payment is not received by the due date, the Company reserves the right to cancel the booking and charge applicable cancellation fees.
- 2.3 Currency: All payments must be made in Chilean Pesos unless otherwise agreed.
- Eligibility
- 3.1 Age: Participants must be at least 21 years old to join the Tour. The minimum age requirement may vary based on the type of Tour.
- 3.2 Riding Experience: Participants must have a valid motorcycle license and demonstrate sufficient riding experience. If requested, the Company may assess your riding ability before allowing participation in the Tour.
- 3.3 Health: You must be in good physical and mental health. Participants must notify the Company of any pre-existing medical conditions or injuries that could affect their ability to safely participate in the Tour.
- Tour Price
- 4.1 Tour Fees: The price of the Tour includes motorbike rental (if applicable), guide services, and the rental of one helmet and other agreed-upon inclusions. Any additional services or expenses, such as fuel, meals, accommodations, or personal expenses, are not included unless specified in the Tour package.
- 4.2 Price Changes: The Company reserves the right to adjust prices in the event of unforeseen circumstances. You will be notified in advance if such changes apply to your booking.
- Cancellations and Refunds
- 5.1 Cancellation by Customer: If you wish to cancel your booking, you must notify the Company in writing. Cancellations made 90 days or more before the Tour’s departure will receive a full refund, minus a processing fee. Cancellations made within 90 days of the Tour departure will be subject to a 50% cancellation fee. Cancelations within 30 days are not refundable.
- 5.2 Cancellation by Company: The Company reserves the right to cancel or modify the Tour for reasons such as unforeseen weather conditions, safety concerns, or force majeure. In the event of a cancellation, you will be offered a full refund or the option to reschedule the Tour, depending on availability.
- Tour Conduct
- 6.1 Safety Gear: All participants must wear approved protective gear, including a helmet, gloves, and appropriate clothing. The Company provides a Helmet as part of the Tour package, but participants are encouraged to bring their own gear for maximum safety.
- 6.2 Obeying Local Laws: Participants must comply with all local traffic laws, regulations, and road safety rules during the Tour. Failure to comply may result in immediate expulsion from the Tour without a refund.
- 6.3 Responsible Riding: Participants must ride responsibly, respect the environment, and follow the guide’s instructions. Any participant deemed to be riding recklessly or endangering others will be removed from the Tour without refund.
- Insurance
- 7.1 Travel, Accident & Health Insurance: It is strongly recommended that all participants obtain comprehensive insurance covering medical emergencies, injuries and accidents, trip cancellations, lost luggage, and other relevant risks.
- 7.2 Motorbike Insurance: The Company provides insurance coverage for third party medical care and death in line with the Chilean Law only. Accidental damage to the motorbike or third parties’ property or theft of the motorbike, are not insured. Insurance services are subject to the terms and conditions of the insurance policy. Participants may be liable for all charges in the event of damage or loss.
- Liability and Waiver
- 8.1 Assumption of Risk: You acknowledge that participating in a motorbike tour involves inherent risks, including accidents, injury, disability or death. By booking and participating in the Tour, you voluntarily assume all risks associated with motorbike riding and outdoor activities.
- 8.2 Release of Liability: You agree to release and hold harmless the Company, its staff, and affiliates from any and all claims, damages, or losses arising out of or in connection with your participation in the Tour.
- 8.3 Indemnity: You agree to indemnify and defend the Company against any claims, damages, or legal actions resulting from your actions or negligence during the Tour.
- Tour Changes and Modifications
- 9.1 Changes to Itinerary: The Company reserves the right to alter the Tour itinerary due to weather conditions, road closures, or other unforeseen circumstances. In such cases, alternative routes or activities will be provided where possible.
- 9.2 Personal Changes: If you wish to modify your booking, the Company will do its best to accommodate your request, subject to availability and additional fees.
- Privacy and Data Protection
- 10.1 Personal Information: The Company will collect personal information necessary for booking, safety, and communication purposes. This information will be handled in accordance with our privacy policy.
- 10.2 Consent: By booking a Tour, you consent to the use of your data for operational and marketing purposes as detailed in our privacy policy.
- Governing Law and Dispute Resolution
- 11.1 Governing Law: This Agreement will be governed by the laws of Chile.
- 11.2 Dispute Resolution: Any disputes arising under or in connection with this Agreement will be resolved through negotiation or, if necessary, mediation or arbitration, in accordance with Chilean law.
- Force Majeure
The Company is not liable for any failure or delay in performance under these Terms and Conditions due to causes beyond its reasonable control, including but not limited to acts of nature, war, terrorism, government action, or accidents.
- Miscellaneous
- 13.1 Severability: If any part of these Terms and Conditions is found to be invalid, the remainder shall remain in full force and effect.
- 13.2 Entire Agreement: These Terms and Conditions constitute the entire agreement between you and the Company and supersede any prior agreements or communications.
